Course Application Conditions and Procedures
1. Full payment must be deposited into the Photo Workshop bank account and proof of payment submitted with the Part Time Course Application form.
2. Applications will only be processed once the application fee has been paid and proof of payment has been received.
3. Enrolment is confirmed with a letter of registration.
4. Once registered, a participant cannot postpone, defer or change courses unless extraordinary circumstances prevail, and an application is made three weeks prior to the course starting. In such a case, a written request must be presented to the Manager: Programmes and a fee of R100 will be levied for every change of course.
5. After the payment agreement has been correctly completed and signed by the participant or a guardian (for participants younger than 18), no changes or alterations will be allowed, unless they have been authorised by the Manager: Programmes or the Head of Market Photo Workshop.
6. The Market Photo Workshop reserves the right to reschedule or cancel courses. If this occurs, refunds to participants will be paid in full. Participants will be required to complete a refund form. See terms and conditions below for more detailed information on cancellations.
7. All work produced by a participant throughout the duration of an attended course may be used by the Market Photo Workshop for archival, marketing and publicity purposes.
8. Although the Market Photo Workshop is doing its best to ensure smooth learning during days of load shedding, the Market Photo Workshop will not be held liable for any inconveniences that could be attributed to load shedding. Please note that classes could be altered in the event of load shedding.
9. The Market Photo Workshop will not be held liable for the loss of data or work. The onus lies with the participant to ensure that work is backed up and formatted correctly. 10. All participants are required to familiarise themselves with the official code of conduct issued during orientation, failure to do so will not indemnify any participant in the case of an infringement or contravention. Admission to the premises, use of facilities, and participation in projects, exhibitions, and public programmes is strictly reserved.
11. Please note that the Market Photo Workshop reserves the right to market its events, projects and exhibitions to all registered participants unless they opt out in writing. 12. Plagiarism is a serious academic offense. Should a participant be found to have submitted photographs that are not their own, the Market Photo Workshop reserves the right to exclude the participant from the course.
Terms and Conditions
1. The participant enters into a contractual relationship upon acceptance of all the terms and conditions in the Agreement.
2. The participant is legally bound to the Agreement. It does not matter if the payment of fees is paid by someone other than the participant (e.g. a parent, guardian, sponsor/funder or any other third party), the contract is with the participant who will be the beneficiary of the training services and material.
3. The right to tuition is not transferable.
4. Participants will be charged a 'change of course fee' of 5% of the new course fee should they wish to transfer from one class to another.
5. Participants are responsible for ensuring that they are registered for the correct course and that they adhere to the latest and correct entrance criteria. criteria for their chosen courses.
6. Where an outside funder sponsors the participants' course (e.g. a learnership), it is the funders' responsibility to ensure that the participants fulfil the entrance criteria. Should MPW be required to cancel the participants' registration because they are not eligible for the course, the funder will be responsible for any cancellation fees.
Cancellations
1. Cancellation of Registration
1.1 Participants remain liable for any amounts owed to MPW as at the date of written notice of cancellation. 1.2 Participants have the right to cancel any advanced registrations and can claim a refund; however, MPW may impose a reasonable charge for such cancellation but may not withhold the entire amount paid under conditions specified below.
1.3 A cancellation fee may not be charged where the participant is unable to commence their studies due to the death or hospitalisation of the participant. Similarly, no cancellation fee may be charged to a third party who is unable to honour the registration due to the death or hospitalisation of the participant.
1.4 A reasonable cancellation charge is determined according to the circumstances of each case and is based on the training already delivered to the participant at the time of cancellation, the reasons for cancellation as well as the notice period given by the participant.
2 Cancellation of contact studies before completion
2.1 In the event that participants cancel their studies before completion, MPW will be entitled to claim full payment for the course unless compelling reasons are provided which are beyond the control of the participant (unforeseen circumstances) and cannot be mitigated.
2.2 If a participant has paid their total fees in advance but cancel their studies prior to completing the course for reasons beyond the participants control (unforeseen circumstances) and for which a mitigation plan is not feasible, MPW may charge the participant for all training delivered until the date of cancellation and must refund the participant the remainder of the fees paid in advance, however MPW will also charge a cancellation fee.
3 Cancellation due to unforeseen circumstances
3.1 MPW may not accept any payment from participants when it is unable to provide the training programme due to insufficient numbers, change of programme or training venue.
3.2 If MPW accepts such payment and then is unable to provide the training to the participant, MPW must refund the participants the amount paid, plus interest at the prescribed rate from the date the participant made payment to the date the participant is reimbursed. The participant may also be compensated for direct incidental costs if the circumstances leading to the cancellation of training was within the control of MPW, and MPW failed to take adequate steps to notify the participant in advance.
4. Registration cancelled by the participant
4.1 In the event of any participant cancelling their studies for any reason whatsoever, this does not absolve the participant from full liability for the payment of fees and any other charges and shall be dealt with in accordance with the cancellation and refund policy.
4.2 The participant's failure to make progress with their training, or to complete a course for whatever reason, shall in no ways entitle them to a reduction in fees, a refund on fees paid in advance nor will it absolve them from full liability for outstanding payment of fees and other charges. 4.3 Participants requesting cancellation are required to complete a Cancellation of Registration form and indicate one or more relevant grounds for cancellation.
4.4 After the participant's account has been validated, the grounds for cancellation will be considered by Courses Management and submitted to the Head of MPW for final approval.
